These Terms of Service ("Terms") govern your access to and use of Appthumb at https://appthumb.com(the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Appthumb helps you redesign App Store screenshot thumbnails using automated analysis and AI-generated images based on public listing data you provide. Features, pricing, and availability may change. Charges shown at checkout apply to your purchase.
2. Eligibility and accounts
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You are responsible for your account credentials and all activity under your account. Guest sessions may be used without registration; linking a guest project to an account is subject to our product rules.
3. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of any applicable law
- Submit URLs or content you do not have the right to use, or that infringes intellectual property or privacy rights
- Attempt to bypass paywalls, download restrictions, or security controls (e.g., accessing paid HD assets without purchase)
- Reverse engineer, scrape, or overload the Service except as we allow
- Resell or redistribute the Service or generated outputs as a competing service
You represent that you have the rights needed for any App Store listing you submit and that your use complies with Apple's and other third parties' terms.
4. Intellectual property
Your content
You retain ownership of materials you provide (e.g., listing URLs and underlying app assets). You grant us a license to use that content to operate the Service, including storing, processing, and displaying it to you.
Generated output
Subject to payment of applicable fees, we grant you a license to use the high-resolution exports you purchase for your app marketing, subject to these Terms and any third-party AI provider restrictions. Preview images may include watermarks and are for evaluation only until purchased.
Our property
The Service, software, branding, and documentation are owned by us or our licensors. You may not copy or use our trademarks without permission.
5. Purchases and refunds
Prices are shown before checkout. Payment is due at the time of purchase. Unless required by law or stated otherwise at checkout, fees are non-refundable once HD files are delivered or download access is granted. See our Refund Policy for details. You are responsible for taxes where applicable.
6. AI-generated content
Outputs are generated automatically and may contain errors, artifacts, or content that does not match your brand. You are responsible for reviewing all images before publishing to the App Store or elsewhere. We do not guarantee App Store approval or marketing results.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50).
9. Indemnity
You will defend and indemnify us against claims arising from your use of the Service, your content, or your violation of these Terms or third-party rights.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or for operational or legal reasons. Sections that by nature should survive (e.g., intellectual property, disclaimers, limitation of liability) will survive termination.
11. Changes
We may modify these Terms. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless applicable law requires otherwise.
